VACATION AGAIN BY JEN LLC — TERMS AND CONDITIONS

These Terms and Conditions (the “Terms”) constitute a binding legal agreement between Vacation Again By Jen LLC (“Agency”) and the individual(s) booking travel (“Client”). By submitting payment, signing authorization, or confirming a booking, Client acknowledges and agrees to be bound by these Terms.
1. Booking and Reservations
1.1 Independent Suppliers
The Agency arranges travel services exclusively through independent third-party suppliers, including but not limited to airlines, cruise lines, hotels, tour operators, transportation providers, insurance companies, and consolidators (“Suppliers”). Suppliers are independent entities and are not employees, agents, or representatives of the Agency.
1.2 Booking Confirmation
A reservation is not considered confirmed until written confirmation is issued by the Agency. All prices, schedules, and availability are subject to change at any time prior to full payment being received and confirmed by the Supplier.
1.3 Supplier Terms Apply
Client acknowledges that all travel is subject to the individual terms, conditions, and policies of the relevant Suppliers. These Supplier terms govern availability, pricing, cancellations, changes, baggage allowances, entry requirements, refund eligibility, and all other travel-related matters.
2. Fees, Payments, and Chargebacks
2.1 Planning and Service Fees
Planning fees, research fees, professional service fees, and deposits assessed by the Agency are non-refundable and compensate the Agency for time, expertise, and administrative services, regardless of whether travel is ultimately booked.
2.2 Payment Authorization
By providing payment information, Client authorizes the Agency to process charges for approved travel services. All payments are processed in U.S. Dollars (USD) through a PCI-compliant payment processor.
2.3 Payment Deadlines
Payments must be received by the deadlines specified by the Supplier. Failure to make timely payment may result in cancellation of the reservation and forfeiture of any funds paid, including non-refundable deposits and Agency fees.
2.4 Chargebacks and Payment Disputes
Except in cases of fraud, Client agrees not to file a chargeback or payment dispute for reasons related to Supplier penalties, dissatisfaction with Supplier performance, itinerary changes outside Agency control, or cancellations due to force majeure. If Client initiates a chargeback, the Agency reserves the right to recover all associated costs, including administrative expenses, Supplier penalties, collection fees, and reasonable attorney’s fees.
2.5 Funds Transmitted to Suppliers
Once the Agency transmits funds to a Supplier, the Agency has no control over refund timelines, denial of refunds, or imposition of penalties.
3. Cancellations and Changes
3.1 Client Cancellations
All cancellations must be submitted in writing. All deposits and Agency fees may be non-refundable. Additional Supplier cancellation penalties may apply.
3.2 Client-Requested Changes
Requests for itinerary changes after booking confirmation may result in additional fees, increased pricing, or Supplier-imposed penalties. Some bookings cannot be modified. All change requests must be submitted in writing.
3.3 Agency-Initiated Changes
The Agency reserves the right to modify or cancel a Client’s booking due to circumstances beyond its control, including Supplier actions, schedule changes, or force majeure events. Refunds, if any, will be subject to Supplier policies.
4. Travel Documentation Requirements
4.1 Client Responsibility
Client is solely responsible for obtaining, maintaining, and carrying all required travel documents, including passports, visas, identification, and health documentation.
4.2 Government Identification Requirements
Acceptable identification requirements may be found at www.tsa.gov. Beginning May 7, 2025, a REAL ID–compliant license or passport will be required for domestic U.S. flights.
4.3 Passport Validity
Many countries require passports to remain valid for at least six (6) months beyond entry or return date.
4.4 Minor Travelers
Minors may require additional documentation, including notarized parental consent.
4.5 Accuracy of Traveler Information
The name, date of birth, and gender provided to the Agency must exactly match government-issued identification.
4.6 Document Review
Clients must review all travel documents within 24 hours. Failure to report errors releases the Agency from responsibility.
5. Liability and Limitation of Responsibility
5.1 Intermediary Role
The Agency acts solely as an intermediary between Client and Suppliers and is not responsible for acts, errors, omissions, negligence, or misconduct of Suppliers.
5.2 No Warranty
The Agency makes no warranty, express or implied, regarding Supplier performance or services.
5.3 Incidental and Consequential Damages
The Agency shall not be liable for incidental, consequential, or indirect losses, including missed connections, lost vacation time, lodging expenses, or transportation disruptions.
5.4 Client Responsibility
Client is responsible for complying with all laws, regulations, health requirements, and Supplier terms.
6. Travel Insurance
The Agency strongly recommends purchasing comprehensive travel insurance covering cancellation, interruption, medical emergencies, evacuation, delays, baggage loss, and Supplier default. Clients who decline insurance assume full financial responsibility for all resulting losses.
7. Risks of Travel and Government Advisories
Client acknowledges that travel may involve risks including severe weather, political instability, terrorism, health hazards, pandemics, natural disasters, and transportation failures. Client assumes all risks associated with travel and agrees that the Agency shall not be liable for injury, loss, damage, delay, inconvenience, or expense related to such risks.
The Agency urges Client to consult official U.S. government resources, including but not limited to:
- U.S. Department of State (www.state.gov)
- Centers for Disease Control and Prevention (www.cdc.gov)
- Smart Traveler Enrollment Program (step.state.gov)
8. Health, Safety, Entry, and Criminal Restrictions
Entry and exit requirements vary by country and may change without notice. Client is responsible for confirming all requirements.
Criminal records, including DUI/DWI, may restrict international entry. Clients must verify requirements independently. Because Agency will not inquire into the criminal offense history of its clients, travelers who may be impacted by an entry restriction on this basis should consult with the U.S. State Department (travel.state.gov) or other reliable source of information for the current entry, exit and visa requirements of the destination in question
The Agency is not liable for denied entry, quarantine expenses, testing requirements, vaccination requirements, or any costs arising from failure to meet health or immigration requirements.
9. Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including weather, natural disasters, war, terrorism, pandemics, or government restrictions. The Agency will refund any unearned funds in its possession, subject to Supplier policies.
10. Privacy and Use of Personal Information
The Agency collects and uses Client information solely for planning and booking travel. Information may be shared with Suppliers as necessary. The Agency does not sell personal data.
11. Code of Conduct
The Agency reserves the right to refuse service or cancel travel arrangements, without refund, in the event the Client engages in abusive, threatening, fraudulent, or inappropriate conduct toward Agency personnel, Suppliers, or other travelers.
12. Governing Law and Dispute Resolution
This Agreement is governed by Oregon law. All disputes shall be resolved exclusively in the courts of Lane County, Oregon.
13. Client Acknowledgment and Representations
By authorizing payment or confirming a reservation, Client acknowledges that:
- They are at least 18 years of age and legally competent to enter into this Agreement.
- All information provided is true, accurate, and complete.
- They agree to be bound by these Terms and all applicable Supplier terms.
- They are financially responsible for all travel arrangements made on their behalf.
- They understand that fraudulent, speculative, or abusive bookings are prohibited.
- They represent and warrant that all travelers included in the booking consent to and are bound by these Terms.
